Calton Deeds

YAS Index to "Calton Deeds" ref. DD203

The 'Calton Deeds' were extensively used by J.W. Morkill in his book The Parish of Malhamdale, published in 1933 where many are translated and relate to the estates of the Lambert family of Calton. They were called 'Calton Deeds' by Morkill to distinguish them from the 'Tarn Deeds', which are also held at the YAS and form part of the Bradfer-Lawrence Collection. The two sets of deeds were separated when the former Lambert estates were split up in 1785 and the Tarn Deeds passed to the Lister family. The Calton Deeds are held by the Yorkshire Archaeological Society External Website logo archive in Leeds and the catalogue descriptions are reproduced here with their permission.

Introduction

These 'Calton Deeds' were part of the archives of the family, Barons Ribblesdale, and were calendared by Tempest together with deeds etc. relating to Gisburn, Swinden, and in Craven, and material relating to the family. These documents are now part of the Bradfer Lawrence collection (MD 335) at the YAS, and contain a letter from J.W. Morkill dated 24 Feb. 1909 acknowledging receipt of the 'Calton Deeds' on loan. These subsequently remained with Morkill family papers at the offices of Charlesworth, Wood and Brown, solicitors, where they were listed by the National Register of Archives in May 1965. A few further Calton deeds were added to subsequent to her first arrangement of the deeds. These were not borrowed by Morkill, but remained with the main collection (now MD 335)

This arrangement of the deeds follows that made by the NRA in 1965. Mrs. Tempest's references are given at the end of each entry and the descriptions given are copied from the NRA list.

Airton

1.       [1.12 cent.]         Feoffment from Thomas son of Suan de Stavelai to Hugh de Kalton half a carucate of land in and all appurtenances in wood, plain, pastures, parks and fields and all the easements of the vill except the mill and his lordship of the vill to hold of him and his heirs for 6 shillings annual rent payable at St. Martin and Pentecost for all services except the fine of the County of York and the wapentake, Thomas having been given 4 marks of silver. 2.       8 June 1279          Confirmation from John de Feusere to the abbot and convent of Dereham of 5 bovates in Airton and 5 bovates in Scosthorp with tofts, crofts, meadows and all other lands etc. which they hold of his fee in Calton, and Scosthorp in free alms yielding to the abbot of Fountains 6 pence annually at the terms of St. Martin and Pentecost and to the heirs of Eustace de Rilleston 12 pence at St. Martin in the Winter and to him and his heirs 2 pence at Christmas, one penny and one obol on the eve of Palm Sunday and one penny on the Saturday before Michaelmas for all services except forinsec service of the lord King. William also recognises that he is bound to the abbot and convent in the annual rent of 35 shillings payable at Pentecost and St. Martin in the Winter for 8 bovates land and 8 acres land and meadow which he holds of them in Calton and in the forinsec service belonging to that tenement and grants that he will acquit and defend a bovate in Calton which he holds of them against Sir Eudo de la Zusche the chief lord of the fee concerning all services etc.. . 3.       23 Oct. 1535 [27 Henry VIII]         Bond of Robert Smyth of Airton, husbandman, Edward Wygan of the same, husbandman, and John Wygan of Kirkby, husbandman, to John Lambart, senior, gent., in £20 to ensure that Robert Smyth will come and subject himself to Lambart before Christmas, acknowledge offences done to and abide upon him and his award. 4.       9 Oct. 1536 [28 Henry VIII]          Feoffment from John Lambart of Skipton, lord of Airton in Craven, vice-chancellor of the county palatine of Lancaster, receiver of the lord King of the county of Lancaster and one of the King's customers of Kingston upon Hull, to Henry Swier of Airton of an empty piece of land of his waste in Airton next to Henry's lordship and next to the chapel of St. Helen in Airton, containing 14 virgates in length and 7 in breadth, yielding annually a penny and an obol. 5.       9 April 1539 [30 Henry VIII]         Power of attorney from Alice Salley, widow, and Johanna, Jovnetta and Helen Nunfrere, daughters and 4 of the coheirs of Richard Nunfrere to John Watkynson, husband of Agnes their sister the fifth coheir, to demand against John Hergraves and Margaret his wife late wife to William Nunfrere their brother, deceased, all deeds concerning their inheritance in Airton and Halton near Bolton. 6.       30 Sept. 1539  [31 Henry VIII]         Feoffment from John Lambart of Calton in Craven, gent., in fulfilment of the settlement made between Robert Lambart of Owton, co. Durham, esq., and himself concerning the marriage of his son John and Robert's daughter Elizabeth, to Nicholas Lambart, gent., son and heir of Robert and Thomas Proctour of Cowper Cote of his manors of Airton and Winterwellhall in Skipton with appurtenances in Airton, Skipton, Malham, Elslack and Burnsall, 7 messuages and 10 bovates in Calton and all his messuages, lands, etc., in Airton, Skipton, Kirkby in Malhamdale and Scosthorpe. 7.       28 Aug. 1544 [36 Henry VIII]         Quitclaim from Thomas Symson of Scosthorp yeoman to John Lambart of Calton, senior, lord of Airton,of all right in the manor of Airton which he may have by reason of a grant from Lambart. [C67]

8.       20 Aug. 1560 [2 Elizabeth]         Feoffment from John Lambart of Calton lord of the manor of Airton to Richard Preston son of William Preston son of Adam Preston senior of an empty place in his waste in lying between his barn and William Preston son of Adam Preston junior's (with) stacks (stakketa) of hay or straw yielding annually one obol. 9.       1 April 1567          Feoffment from Richard Smyth of Airton and Jane (Johanna) his wife, one of the sisters and heirs of William Nonfrere, to Rowland Brasha of Kirkby and Thomas Grere of West Marton of all lands both in their possession and in reversion after the death of Margaret Hargraves in and Calton, to the use of Richard and Jane for life, then their son John Smyth and his heirs, failing that John Lambarte of Calton and his heirs male, failing that the right heirs of Jane.

10.     8 Feb. 1567 [9 Elizabeth]         Bargain and sale from Oliver Foster of Scosthorp and Isabel his wife, one of the daughters and heirs of John Salley and Alice his wife who was one of the sisters and coheirs of William Nonfrere, to Richard Smyth of Airton in Craven, tailor, of the parcel of William Nonfrere's inheritance which falls to Isabel and which is now held by John Hargraves and Margaret his wife, formerly wife of William Nonfrere, as her jointure. 11.     6 Aug. 1567 [9 Elizabeth]         Settlement by feoffment from John Lambert of Calton in Craven esq., to George Lord Clifford son of the Earl of Cumberland, Matthew Redman esq., Thomas Clifford of Asperden esq., William Lyster esq., William Arthyngton, gent., George Clapham, gent., Laurence Preston and Christopher of his capital messuage of Airton called Airton Hall and various messuages and lands (names) to the use of Benjamin Lambert his son and heir apparent and Elizabeth his wife for life, then their heirs and failing that of John and his heirs, in fulfilment of an agreement between Henry Earl of Cumberland and Lambert. 17.     28 Sept. 1598 [40 Elizabeth]          Lease from Benjamin Lambarte of Airton, esq., to Roger Preston the elder of Airton, husbandman, of a messuage, 3 oxgangs, 2 acres arable of Tharan Holme, 3 acres meadow of Tharan Holme Ings and foreland year the Chappellmyre called St. Ellen Land for the lives of Roger Preston, Gennett his wife and Richard his son at 25s 8d annual rent. 18.     2 April 1600         Bond of Thomas Swyer of Hitton, clerk, and Henry Swyer of Airton, yeoman, to Josias Lambart of Malham esq., in £300 to execute at reasonable request a deed releasing their title to mills in Airton and Scosthorp and land in Airton. [C122]

19.     28 Feb. 1600/1601         Quitclaim from John Holmes of Holden Park, yeoman, to Josias Lambert of Airton esq., of all claim to the mills of Airton and Scosthorp and lands in assigned to him by Henry Swyer. [C122]a

21.     18 July 1601         Assignment from James Rawden of York, merchant, and Christabel his wife, to Josias Lambert of Malham esq., of a moiety of 2 water corn mills, one called the Nether Mill in Airton and the other called Scosthorp Mill, leased to Christabel by Henry Swier. Includes the Rawdens' bond for performance.

22.     20 Sept. 1606          Quitclaim from Adam Preston of Airton, yeoman, to Josias Lambart of Calton, esq., of all arrears of rent due to him from any leases from Adam and William Preston his grandfather and father, to Richard Parker late of Malham deceased. [C132]

23.     14 Aug. 1609          Feoffment from Henry Swyer the elder of Airton, yeoman, and Grace his wife to Josias Lambart of Calton esq., of a close of meadow called Jeffrey Waters and a close of meadow called Hinggill in Airton. Includes Swyer's bond for performance. [C135]

25.     5 March 1611/1612         Assignment from William Brigge of Airton, husbandman, to Josias Lambarte of Calton, esq., of the west moiety of a parcel of ground on the east side of Brownbarr in Airton for the remainder of a term of 1,000 years created in a lease from James Smith to Brigge. 26.     5 March 1611/1612         Lease from Josias Lambarte of Calton, to Thomas Hall of Airton, husbandman, of a close of meadow called Tormyre in Airton and a parcel of arable and meadow called Hungerill or Hungerhill in Airton for 1,000 years at 4 pence annual rent. [C141]

27.     20 March 1616/1617         Assignment from Rowland Wilson of Airton, husbandman, to Josias Lambarte of Calton, esq., of closes called Waters, Orr Close, Bleabanke Browe, Todd Crooke, Newbrigg Land and Butts in Airton, reciting earlier deeds. Includes Wilson's bond for performance. [C143]

29.     8 March 1619/1620         Assignment, from Edward Sawley of Airton, yeoman, to Josias Lambert of Calton, of a parcel of arable ground called Kirke Doares and a parcel of meadow called Smyth Teene in Airton for the remainder of a term of 1,000 years created by Josias Lambart. 30.     8 March 1619/1620         Feoffment from Edward Sawley of Airton, yeoman, and Elizabeth Sawley of Airton, widow, his mother, to Josias Lambart of Calton, esq., of 9 parts of a messuage, 2 oxgangs and foreland of ground in Airton divided into 16 parts, and a moiety of a close called Avenholme in Hanlith. 31.     13 March 1619/1620         Lease from Josias Lambarte of Calton, esq., to Edward Sawley of Airton, yeoman, of 9 parts of a messuage, 2 oxgangs and foreland of ground in Airton divided into 16 parts and a moiety of a close called Avenholme in Hanlith for 20 years at a red rose rent to keep harmless Edward Sawley and William Sawley his son and lands at Gilderflatthowe in Hellifield, which they have bought from Josias, from any lease or mortgage which Thomas Lascie has. 33.     26 Nov. 1653         Assignment from John Husband of Kirkby in Malhamdale, bachelor, to John Lambert of Calton, esq., of a barn at Crakemoore leased to William Iveson by Josias Lambert and bequeathed by him to John Husband. Includes John Husband's bond for performance. [C169]

34.     31 Jan. 1679/1680         Lease from John Lambert of Calton, esq., to Hugh Iveson, bachelor, and Margaret Iveson, widow, his mother, of Crakemoore within the township of Airton,of a messuage at Crakemoore with grazing on the High Side or Fell in Airton for 10 beasts more than can be wintered with what grows on the premises for the lives of Hugh and Margaret, remainder to Hugh's heirs during the life of Elizabeth daughter of Thomas Proctor of Stockdale in the parish of Giggleswick, at £2 10s annual rent. Arncliffe

36.     ? [mid 13 cent]         Feoffment from Elias de Gycleswyc to John de Haukeswyc and Alice his wife, daughter, of his mill in Arncliffe with suit belonging to it, and all his land in that vill with all lordship and whatever he had in rents and in lands, and also all his land in the vill of Kirkby and the mill of the vill with suit belonging to it and all lordship there to hold to John and Alice and their heirs, doing forinsec service and the service belonging to the chief lord of the fee for all service and everything belonging to him (Elias) and his heirs. Calton

37.     ?[e.13 cent.] Confirmation from Richard de Calton to God and the monks of the Church of St. Mary of Fountains of all the lands, rents and possessions which he had of the gifts of Alan his father and Hugh de Calton his brother to hold in free alms as the charters which the monks have of him testify, so that neither he nor his heirs will move any claim against the monks. 39.     [c. 1220-1246]         Feoffment from Alice daughter of Richard de Calton to Robert de Fegesere for his homage and service and 20 marks of all the land which she had in Calton both in demesne and in service with customary homages and rents and with half of the mill of Airton to hold of her and her heirs in fee and in free inheritance yielding annually a pound of cumin at Christmas and doing forinsec service. [c. 1230-1260]         Feoffment from Adam son of William de Plumland to Robert de Feheserse of 2 bovates of land with appurtenances and half an acre "loco thosti" in the vill of Calton, one of which was held by Walter Stuce and the other by William son of Matilda, to hold of him and his heirs, Robert having paid 12 marks towards pilgrimage to the land of Jerusalem. 41.     ?[c.1231-1247]         Feoffment from Anger by divine permission Abbot of Dereham and the convent of that place to Robert de Fegeser of 8 bovates with tofts and crofts in Calton, of which they had 6 and one half bovates of the gift of son of William de Plumlond, half a bovate of the gift of Richard Armiger and one bovate of the gift of Alice daughter of Richard de Hamerton, and 8 acres in Calton which Thomas Gaderwitonce held of them, half an acre lying at Stiflat which Hugh Cocus gave them and all the meadow which they had in Milneholm, to hold of them in fee so that they may not give the said tenement to any religious house except their house of Dereham rendering annually 35 shillings of silver, half at Pentecost and half at St. Martin in the winter and doing forinsec service. 43.     ?[1260-1300]         Feoffment from Richard son of John le Machun of Calton to Peter son of Walter de Hagenlit of half an acre of land in the vill and territory of Calton, viz. one rood on Hungerhil and one rood on Dammebergh to hold to Peter and his heirs of the next lord of the tenements. 44.     ?[c. 1261-12671]         Quitclaim from William Mauleverer de Calton to the prior and convent of Bolton of all right in 9 bovates of land with appurtenances and buildings in the vill and territory of Calton and a moiety of the mill of Airton, which he had in exchange for his land of Stordhes of the gift of the prior and convent. In return for this grant the prior and convent have given him, Ermeiarde his wife and Eustace his son food, clothing and other necessaries for their lives, and if the prior and convent suffer any loss or damage over this land by him, they will take away all their grants, according to a charter which he has from them but which cannot be found and which he gave to Sir Eustace de Rylleston and which Sir Elyas his son has as is said. 154.    1518/1519 [10 Henry VIII]         Notification from John Lambart senior, lord of Airton, to the seneschal and bailiff of Lord Clifford that he has appointed Robert Garthe of Skipton, Christopher Lambart, Thomas Kitchyn, William Kitchyn and Thomas Heyber his attorneys to do suit for him to the military court of the Honor of Skipton, in accordance with a statute of 20 Henry VII. 155.    5 April 1540 [31 Henry VIII]      Bill of testimony by John Wygan, Richard Wilson, George Todde and Richard Croke that one Christopher Preston of Airton, husbandman has like an untrue and perjured man sworn that they were with Lancelot Nesfeld gent., in Airton on the eve of Corpus Christi when he committed sundry trespasses according to depositions published before the King's Council at York when in truth Todde and Croke were 3 miles from Airton and Wygan and Wilson came to Airton with John Lambart of Calton a Justice of the Peace who came to settle the matter and on arriving saw no misdemeanours on the part of Lancelot who was there alone but ascertained that Preston and his 2 brothers Henry and Arthur would have killed Lancelot Nesfeld with their staves at their father's instigation if John Spencer and Henry Swyer had not intervened.
