Transcript of a document in the YAS (MD335/1/1/6/8) in which John Lambert of Calton Hall grants the right to various Hanlith yeomen, to use the road across his Calton Moor property to carry coal from the pits near Lainger House in Bordley to their homes. They in return undertake to each bring a load of coal to Calton Hall each year at their own expense.

 

This Indenture of Coven[a]nte made the Sixteenth daie of December in the Sixteenth yeare of the reigne of our sovereigne Lord King Charles by the grace of God of Englannd Scotlannd France and Irelannd Defender of the faith ..

Betweene John Lambart of Calton in Craven in the Countie of Yorke Esquier on the one p[ar]tie and William Preston George Falthropp Robert Lawson William Airton Robert Broughton Christofer Braishey William Braishey Thomas Wilson Robert Sergeantson Richard Hynde Henry Hird Roger Preston Thomas Iveson Thomas Blackburne William Fish William Sergeantson Thomas Atkinson John Anderson and Roger Broughton  of Hanlith in the said County yeomen on the other p[ar]tie.

Whereas the said John Lambart now is and standeth lawfully seized to him and his heires forever in Fee simple of and in All that the Manno[ur] of Calton in Craven aforesaid in the said Countie and of and in all and singular lands tenements meadowes moores commons and appurten[a]nce[s] to the same Manno[ur] belonging and app[ar]teyning and more especially of one Close or p[ar]cell of Coo…r moore ground called Calton Moore also to the same belonging as by good assurannces sufficient in the Lawe may appeare

And whereas the said William Preston George Falthropp and the rest of the said p[er]sons aboue named have heretofore during the life tyme of Josias Lambart Esq[ie]r deceased late father of the said John Lambart hadd used and enioyed one highway with waynes Carts carriages and on horseback and on foote over the said Calton moore for carrying of Coles from the Colepitts to their dwellinghouses at Hanlith aforesaid with the consent and license of the said Josias Lambart

Now this Indenture witnesseth that the said John Lambart for the better confirming of the said way to the said p[ar]ties and for the considerac[i]on hereafter menc[i]oned doth Coven[a]nt promise and grant to and with the said Will[ia]m Preston George Falthropp Robert Lawson Will[ia]m Airton Robert Broughton Christofer Braishey Will[ia]m Braishey Thomas Wilson Rob[er]t S[er]geantson Richard Hynde Henry Hird Roger Preston Thomas Iveson Thomas Blackburne William Fish Will[ia]m S[er]geantson Thomas Atkinson John Anderson and Roger Broughton  their heires and assigns by these p…

That it shall and may bee lawfull to and for them and every of them their heires and assignes to use and enioy the said way over Calton moore before menc[i]oned as hath beene accustomed from henceforth forever hereafter without the lawfull let. suite trouble or incumbrannce whatsoever of him the said John Lambart his heires or assignes or any of them

In considerac[i]on whereof the said William Preston George Falthropp Robert Lawson Will[ia]m Airton Robert Broughton Christofer Braishey Will[ia]m Braishey Thomas Wilson Robert Sargeantson Richard Hynde Henry Hird Roger Preston Thomas Iveson Thomas Blackburne William Fish William Sargeantson Thomas Atkinson John Anderson and Roger Broughton  for themselves and every of them their heires executors admi[nstrators] and assigns do Coven[a]nt promise and grant to and with the said John Lambart his heires and assignes by these presents That e[a]ch of them their heires or assignes yearly and every yeare from henceforth for ever shall yeild and bring upon demand at their owne costs and charges one loade of Coles on horsback to the said John Lambart his heires and assignes and to deliver and leave the same at the now Manner house of the said John Lambart called Calton hall in the said Countie

And in default that they or any of them do make default to deliver the said Coales as aforesaid That then every such p[er]son or p[er]sons so defaulting shall respectiuely every of them pay or cause to bee paid to the said John Lambart his heires or assignes yearly Nyne pence of lawfull English money at the Feast of St Martine the buishopp in winter for every loade of Coales so not brought and delivered as aforesaid to the said John Lambart his heires or assignes any thing herein conteyned to the contrary notwithstanding

In wittnes whereof the p[ar]ties abouesaid to these p.. t Indentures interchangeably have sett their Handes and seales the day and yeare First above written
