Bordley Wills & Probate

The Procters were an influential family in the area who had built up their wealth as tenants of Fountains Abbey. The will of Geoffrey Procter of Bordley who died in 1524/5 provides an insight into just how rich this family had become. He was Auditor to Henry, Earl of Northumberland, a position analogous to that of the land agent of to-day. You can learn more about Geoffrey Procter in the chapter about The Procters of Bordley taken from the work of JW Morkill.

Tim Gray has transcribed a large number of documents relating to the Procter family who have long been associated with Bordley and here you can see various wills and inventories. More examples will be added soon.


William Procter - 1692

In the name of god Amen the 18 day of September one thousand six hundred ninety twou I Willam Proucter of Bordlay in Burnsall parish et doo herby containe my will and last testament as followeth.

First I commend my soule to God who made me and my body to be buryed in ye chapillyard of Rilleston

The condition of this Obligation is such, That if the above bounden Alice Procter ---   ---   ---   ---   ---   ---   ---   ---   - Administratrix of all and Singular the Goods, Chattels, and Credits of Thomas Procter  ---   --- late of ye parish of Burnsal aforesd, her husband ---   ---   and Diocese ---   ---   of York Deceased do make, or cause to be made, a true and perfect Inventory, of all and singular the Goods Chattels and Credits of the said Deceased, which have or shall come to the Hands, Possession or Knowledge of her --- the said Alice Procter ---  ---  ---   ---   or into the Hands and Possessions of any other Person or Persons for her and the same so made, do Exhibit, or cause to be Ex- hibited into the Registry of the Exchequer Court in YORK at or before the eighth  ---   ---   day of May -- next ensuing.   And the same Goods, Chattels and Credits, and all other the Goods, Chattels and Credits of the said Deceased, at the time of his death, or which at any time after shall come to the Hands or Possession of the said Alice Procter --- or into the Hands and Possession of any other Person or Persons for her do well and truly Administer according to Law.  And further, do make or cause to be made a true and just Account of her said Administration, at or before the eighth ---  ---  day of August  --- next ensuing, and all the rest and residue of the said goods, Chattels and Credits, which shall be found remaining upon the said Administratrix her Account, the same being first Examined and Allowed by the Judge or Judges, for the time being of the said Court, shall deliver and pay unto such Person or Persons respectively, as the said Judge or Judges by his or Parliament in that behalf made, shall limit and appoint.   And if it shall here-after appear that any Last Will and Testament was made by the said Deceased, and the Executor or Executors therein named, do Exhibit the same into the said Court, making request to have it allowed and approved accordingly, if the said Alice Proter ---  ---  within bound, being thereunto required, do render and deliver the said Letters of Administration (approbation of such Testament being first had and made) in the said Court, then this Obligationto be void, and of none effect, or else to remain in full Force and Vertue.

Know all Men by these presents That We Margaret Procter of Know Bank in The Parish of Burnsall And County of York Widow Richd. Procter of Boardley in the Parish and County aforesd Yeoman And Jonathan Booth of Burnsall in the Parish & County aforesd Yeoman do stand, and are firmly bounden and obliged unto the Worshipful Willm Ward Doctor of Laws, Commissary of the Exchequer Court of the Most Reverend Father in GOD Lancelot ----------- by Divine Providence, Lord ArchBishop of York Primate of England and Metropolitan lawfully constituted in the Sum of Seventy Pounds of good and lawful Money of Great Britain, to be paid to the said Commissary, or his true and lawful Attorney, Executors, Administrators or Assigns to the which Payment well and truly to be made, We bind us and Every of us jointly and severally for and in the Whole, our and Every of our Heirs, Executors and Administrators and Every of them firmly by these presents sealed with our Seals.
Dated the 5th Day of the Month of February in the Year of our Lord one Thousand Seven Hundred and Forty two.


The condition of this Obligation is such, That if the above bound Margaret Procter Widow relict and Administratrix of all and Singular the Goods, Chattels, and Credits of Richard Procter late of Know:Bank aforesd in the Parish of Burnsall aforesd and Diocese of York Deceased do make, or cause to be made, a true and perfect Inventory, of all and singular the Goods Chattels and Credits of the said Deceased, which have or shall come to the Hands, Possession or Knowledge of her the said Margaret Procter or into the Hands and Possessions of any other Person or Persons for her and the same so made, do Exhibit, or cause to be Exhibited into the Registry of the Exchequer Court in YORK at or before the Fifth day of August next ensuing. And the same Goods, Chattels and Credits, and all other the Goods, Chattels and Credits of the said Deceased, at the time of his death, or which at any time after shall come to the Hands or Possession of the said Margaret Procter or into the Hands and Possession of any other Person or Persons for her do well and truly Administer according to Law. Thomas Procter - 1759

This is the last Will and Testament of me Thomas Procter of Hetton in the Parish of Burnsall in the County of Yorke Yeoman And as touching my Worldly Estate I Dispose thereof as follows   First I Give and Bequeath unto Susannah my Dear loving and Industrious Wife and to her Assigns for and during the Term of her Natural life one Annuity or Yearly Rent of Eighth pounds of Lawfull money of Great Britain to be Yearly Issuing and payable to her and her Assigns During the said time by four Quarterly payments    Towit on the Twenty Ninth day of September  twenty Ninth day of December on the twenty ninth  day of March  and the twenty Ninth day of June by equal portions the first payment thereof to begin and be made on the first of the said days as shall first and next happen after my Desease without any Deduction thereout on Account of ant Taxes or any other matter Cause or thing whatsoever  Out of all and Singular those my Messuages Lands Tenements hereditaments and premisses  Situate lying and being in Hetton aforesaid and in the Township of Bordley and Flasby in the said County Exept the house here in after given to my said Wife and hereinafter given to my Sons Thomas and Silvester and if it shall happen that the said Yearley Rent of Eight pounds or any part thereof to be in arrear or unpaid by the space of Twenty Days next after any of the said days of payment whereat the same is herein before appointed to be paid It is my Will and Mind that then and so often it shall and may be so lawfull to and for the said Susannah and her Assigns into and upon the said Tenements and Premisses or any part thereof to Enter and Distraine and the Goods and Chatteles then and there found from time to time to ………. drive away Impound and detaine until the said Annuity and all Arrearages thereof if any … as all the Charges of the said Distress Shall be fully paid and discharged  And also I Give and Bequeath unto the said Susannah my wife during the Term of her Natural life the New Messuage or Dwellinghouse in Hetton aforesaid and the Garth above the …… hedge and also Liberty to take and fetch Water from the Well at the house where I now live To hold the house Garth liberty of the said well to her and her assigns for and during the Term of her Natural life the said Annuity and house so given to the said Susannah my Wife is in ….. of all third and thirds at Common Law which the said Susannah can shall or may Claime unto or out of all other my  Messuages Tenements and hereditaments belonging to me at the time of my Desease or wherein I then shall have any right of Inheritance   And I Do also hereby give and devise unto my Sons Thomas and Silvester from and after my said Wifes Desease not only the said New house and Garth but also all the remainder of my Messuages Lands Tenements and hereditaments whatsoever and all rights members and appurtenances to the same belonging or appurtaining  in whose Tenures or Occupations Soever the same  or any part thereof now  are or be Situate lying and being in Hetton Bordley Flasby aforesd or elsewhere in the sd County charged now on the …. With the sd Annuity to my said Wife as aforesd  To hold such part thereof as is of the Nature of freehold unto them the said Thomas and Silvester and their heirs  And To Hold all such part and …… thereof as is of the Nature of Leasehold unto them the sd Thomas and Silvester and their Executors Administrators and Assigns for and during all the residue & remainder of all such Term and Terms of Years from and after my Decease as I have therein & which shall be then to Come and Unexpired to take as Tennants in comon not as Joint Tennants  And I do hereby give unto the sd  Thomas ffifty pounds to be paid him within twelve months next after my desease by the sd Silvester my Son out of his Moyety of the said Land and I Do hereby charge my said Son Silvester & the said Moyety ……. And I Do also hereby Give unto the said Susannah my Wife the Sum of Ten pounds to be paid her within twelve months next after my Desease out of my personal Estate by my Executors herein after named  And I Do also give and Devise unto the said Susannah my Wife all such Household Goods as she shall have ……. for, for her  life but from and after her Decease I give the same unto the said Thomas and Silvester my sons  And I Do also further give unto the said Susannah my Wife her Widow Bed Bedding proper and necessary for such Widow  And as to the rest residue & remainder of my personal Estate of what nature or kind Soever I Give and Bequeath the same unto the said Thomas and Silvester my Sons they in the first plase paying thereout all my Just Debts funeral Expenses other Charges of proving and registering this my last Will and Testament and I Do hereby make and appoint the said Thomas and Silvester Joint Executors of this my last Will and Testament thereby revoaking all former Wills and Testaments heretofore by me made   In Witness whereof  I have hereunto sett my hand and Seal this fifth day of August in the Year of our Lord One thousand Seven hundred fifty nine

Richard Procter - 1809

This is the Last Will of me Richard Procter late of Lainger House in the County of York but now of Cracoe in the Parish of Burnsall in the said County Yeoman   I Give and bequeath to my Nephew Richard Procter Son of my late Brother Thomas Procter late of Threshfield deceased his Executors Administrators and Assigns  All and Singular my Moneys out at Interest or otherwise due to me and all other my personal Estate and Effects whatsoever which I shall or may die possessed of  Intitled to at the time of my decease of what Nature or kind soever the same is are or shall or may be and all Securities for Moneys which shall be then due to me Subject nevertheless to his paying thereout all my just Debts Funeral Expences and the probate of this my Will and also paying thereout on that Day twelve Months which shall next happen after my decease the following Legacies Sum or Sums of Money to the following legatees and their respective Executors Administrators and Assigns to whom respectively I hereby give and bequeath the same that is to say to my nephew Robert Procter Son of my said late Brother Thomas Procter the Legacy or Sum of one hundred pounds of lawful Money current in England  To my Niece Margaret Procter daughter of my said late Brother Thomas Procter the Legacy or Sum of one hundred pounds of like Money   To my Niece Ann Procter Daughter of my said late Brother Thomas Procter a legacy or Sum of one hundred pounds of like Money   To my Niece Grace the Wife of Robert Ibbotson of Cracoe aforesaid a legacy or Sum of one hundred pounds of like Money   To my Niece Margaret the Wife of John Cocket a legacy or Sum of one hundred pounds  of like Money  To my Great Nephew William Cocket Son of my said Niece Margaret Cocket a legacy or Sum of ten pounds of like Money  To Ann Brown Wife of John Brown of Calton in the Parish of Kirkby Malhamdale in the said County a Legacy or Sum of ten pounds of like Money  To John Wharf of Bordley in the said County a legacy or Sum of five pounds of like Money   Provided always that if my said Nephew Richard Procter (who I hereby constitute Sole Executor of this my Will) shall sustain any loss by not getting in and being paid the full Amount of any Monies due to me at the time of my decease  upon any Security  or Securities then outstanding or which shall be otherwise due to me upon any Account whatsoever or shall sustain any loss in and by his not fully receiving all such Sum and Sums of Money as shall or may accrue due to him in the Sale or Disposition of any part of my personal Estate  and effects hereby bequeathed to him subject as aforesaid then and in any of the said Cases it is my Will and pleasure and I do hereby expressly direct and order that each of my said Legatees shall bear any such loss or losses as aforesaid (except the same shall happen by or on Account of the willful neglect or default of my said Nephew Richard Procter) along with my said Nephew Richard and they and my said Nephew Richard his Executors and Administrators shall respectively contribute thereto in proportion as the said Legacies and what shall finally accrue and be received by my said Nephew Richard from and out of my said effects shall bear to each other and I do in that case hereby Authorize and empower my said Nephew to deduct from each of the said Legacys accordingly when the same respectively are paid by him under this my Will    In Witness thereof I have to this my last Will Subscribed and set my Hand and Seal this twenty Fifth Day of January in the Year of our Lord one thousand eight hundred and eight
